Reporting Spills

 

The owner or operator of a storage tank must notify the Storage Tank Program when a release or suspected release occurs, if the release of petroleum or other regulated substance equals or exceeds its reportable quantity (listed on this page). Notification must be provided as soon as practicable but no later than 24 hours after the release or suspected release is detected. Operators must notify owners of each release as soon as practicable but no later than 24 hours after the release is detected. These initial notices may be provided orally or in writing. 

 

Release Written Report

The owner or operator must also submit a written report to the Storage Tank Program within 14 days from detection of a release. The report must include the following information: 

  • extent and nature of the release or suspected release;

  • regulated substance released;

  • quantity of the release;

  • period of time over which the release occurred;

  • initial response and corrective action taken;

  • anticipated response and corrective action to be taken after the date of the report;

  • any additional information requested by the Storage Tank Program.

Reportable Quantities 

Petroleum: 25 gallons or more must be reported. 

Other hazardous substances:  Reportable quantities are specified in the Navajo Nation Comprehensive Environmental Response, Compensation, and Liability Act (“NNCERCLA”), 4 N.N.C. §§ 2101-2805.

All reporting, investigation, and confirmation actions must meet the requirements of the Navajo Nation Underground and Aboveground Storage Tank Act and 40 C.F.R. §§ 280.50 through 280.53.
