Notification Requirements

 

Owners and operators of aboveground and underground storage tanks must provide the Storage Tank Program with certain information about their tank operations, releases, and corrective actions. An overview of these notification and reporting requirements is provided on this page. Owners and operators should check the Storage Tank Act and the appropriate storage tank regulations, and guidance to identify all requirements applicable to their specific facility.

 

New Storage Tank Notification 

Each owner or operator of a new storage tank, installed after 2012, must submit a completed original notarized Tank Information Form to the Storage Tank Program. Complete instructions are at the top of the form. Navajo Nation Underground and Aboveground Storage Tank Act (“NNSTA”), Section 1531(A).

New Owner or Operator Notification

If the owner or operator of a storage tank changes, then the new owner or operator must file a new Tank Information Form within 30 days from the date of change. 

New owner or operator notification requirement: NNSTA, Section 1531(B).

Depositor Notification

Any person who deposits regulated substances into a tank that has a new owner or operator must notify the new owner or operator of the notification requirements for new owners and operators. 

Depositor notification requirement: NNSTA, Section 1536.

Seller Notification 

Any person who sells a storage tank—which will continue to be used as a storage tank and not some other purpose—must notify the purchaser of the notification requirements for new owners discussed above.

Underground Storage Tanks Taken Out of Operation 

Owners and operators of an underground storage tank that has been taken out of operation after January 1, 1974 but has not been removed from the ground must submit a completed original notarized Tank Information Form to the Storage Tank Program. Complete instructions are at the top of the form. NNSTA, Section 1531(A).

Underground Storage Tanks Taken Out of Operation before January 1, 1974

Owners and operators of underground storage tanks taken out of operation before January 1, 1974 must notify the Storage Tank Program of the tank and its location. 

Any person who discovers an underground storage tank that was taken out of operation prior to January 1, 1974 but is still in the ground must notify the Storage Tank Program of the tank and its location. NNSTA, Section 1533.
