Fees and Tariffs

 

Storage Tank Fees can be paid in person, over the phone, or through mail.

Storage Tank Tariff payments must be paid in person or through mail.

Fees and Tariffs paid by check or money order should be made payable to the “Navajo Nation Storage Tank Program”.
For Annual Tank Fees and Monitoring Fees please include the top portion of the invoice.

Credit card payments are accepted by phone for registered storage tanks. However, first time registration application and fees must be remitted by mail or in person. Contact Kristina Silversmith to arrange making a payment by phone. Before making the payment, you will be asked to email Kristina Silversmith all supporting documentation.

Fee payments made by phone: Have your invoice available so that you can provide the following information: invoice number, amount due, due date, facility (NAV) number, owner or operator name, credit card information.

Tariff payments cannot be made by phone.

Registration Fee

 

An owner or operator of an existing storage tank must pay a one-time tank registration fee of $100 per tank. The same fee applies to storage tanks taken out of operation after January 1, 1974 but not removed from the ground.  

 

Annual Tank Fee

 

An owner or operator of a storage tank must pay an annual fee of $150 per tank. This fee applies to each compartment in a compartmentalized storage tank, meaning that a fee of $150 must be paid for each compartment. 

The total amount of tank fees due is based on the number of operating and temporarily closed storage tanks owned or operated within a calendar year. An invoice showing the total amount of tank fees due for the current year will be mailed to each owner or operator on or before January 2 each year. Annual tank fees must be received by the Storage Tank Program by March 1 of that year.

Monitoring Fee

 

An owner or operator of a storage tank is required to pay monitoring fees of $150 per tank per day for tank installation, removal, or other activities requiring field monitoring. The Storage Tank Program will mail the owner or operator an invoice reflecting the amount of monitoring fees due after the conclusion of the activities requiring field monitoring. Payment must be received by the Storage Tank Program within 30 days of the date of the invoice.

 

Tank Fees - Interest on Late Payments 

 

An owner or operator will be charged interest on any late payments. If payment is not received by the Storage Tank Program by the due date the owner or operator will be assessed interest at a rate equal to the federal short-term rate on the date of assessment, plus 3%. The Storage Tank Program will calculate the interest due as of the date the late payment is received and will send an invoice to the owner or operator reflecting the additional amount due.

Tank Fee Guidance

 

Tariff on Gasoline 

 

A tariff of 1¢ (one cent) per gallon applies to any regulated substance placed in a tank on Navajo Nation land. The distributors of the motor vehicle fuel, diesel fuel, and aviation fuel placed in the tanks must make this payment to the Storage Tank Program on a monthly basis. If an owner or operator is engaged in the bulk distribution of regulated substance, then he or she is responsible for paying the tariff. Distributors making payment must submit monthly payment reports and an annual reconciliation report to the Storage Tank Program demonstrating payments have been made in full.  

 

Tariff - Deadline

 

Owner or operator engaged in bulk distribution: due annually on or before March 31 for the preceding year. 

Distributors: due the last business day of the month after the fuel is deposited into a storage tank.  

 

Tariff - Late Fee

 

Interest equal to the Internal Revenue Service rate will be imposed on any unpaid amount of tariff from the date the payment was due to the date payment is received. 

 

Tariff - Missed Payment

 

Any missed payments are subject to a penalty of 5% of the remaining amount due.

 

Tariff - Lien

 

A lien may be imposed on all real and personal property belonging to the tariff payer if any tariff, interest, or penalty imposed is not paid when due. The lien will be for the unpaid amounts due. 

 

Red Tag Program

 

The Storage Tank Program may prohibit fuel delivery to storage tanks with late or unpaid tariffs by affixing a red tag to the tank notifying all distributors that fuel deliveries are illegal.
